Welcome to Nobrainrot! The terms “we”, “us”, and “our” refer to Nobrainrot Sp. z o.o. (“Nobrainrot”). Nobrainrot operates this store and website (the “Services”), including all related information, content, features, tools, products, and services, to provide you, the customer, with a curated shopping experience. Nobrainrot is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with any policies referenced herein (“Terms”), describe your rights and responsibilities when you use the Services.
By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy [LINK]. If you do not agree, you should not use or access our Services.
SECTION 1 – ACCESS AND ACCOUNT
You must be at least the age of majority in your jurisdiction to use the Services, or you have given us consent to allow any of your minor dependents to use the Services on devices you own, purchase, or manage.
You agree to provide current, complete, and accurate account, billing, and shipping information. You are solely responsible for maintaining the security of your account credentials and for all activity under your account.
You may not transfer, sell, assign, or license your account to any other person.
SECTION 2 – OUR PRODUCTS
Shift is a hardware and software solution to help you block distractions and regain focus on your smartphone.
We have made every effort to display our products and services accurately, but colors and product appearance may differ depending on your device and settings. We do not guarantee the appearance or quality of products or services purchased will meet your expectations.
All descriptions, pricing, and availability are subject to change at our discretion, with or without notice. We may limit quantities or discontinue any product at any time.
Our NFC tag is designed to last up to ~10 years under normal use.
We are not responsible for damage caused by misuse, physical destruction, external factors (water, heat, magnets, etc.), or attempts to modify, clone, hack, or reverse-engineer the product.
Any attempt to copy, counterfeit, or tamper with the product or its software will result in legal action.
SECTION 3 – ORDERS
When you place an order, you are making an offer to purchase. We reserve the right to accept or decline your order at our discretion. Orders are not accepted until confirmed by us. Payment must be received and processed before your order is accepted.
Orders are subject to our Refund Policy [LINK]. You represent that your purchases are for personal use and not for commercial resale or export.
SECTION 4 – PRICES AND BILLING
Prices, discounts, and promotions are subject to change without notice. Unless stated otherwise, prices do not include taxes, shipping, handling, customs, or import charges.
You agree to provide accurate purchase and payment information and to promptly update your details. You represent and warrant that you are authorized to use the payment method provided and will pay all applicable charges.
SECTION 5 – SHIPPING AND DELIVERY
We are not liable for shipping and delivery delays. All delivery times are estimates and not guaranteed. Once we transfer products to the carrier, title and risk of loss pass to you.
SECTION 6 – INTELLECTUAL PROPERTY
All content, features, and trademarks on our Services—including text, images, graphics, product names, designs, and arrangements—are owned by Nobrainrot, Shift, our affiliates, or licensors, and protected by law.
You may only use the Services for your personal, non-commercial use. Unauthorized use is prohibited.
SECTION 7 – OPTIONAL TOOLS
You may be given access to third-party tools as part of the Services, which are provided “as is” and “as available” without any warranties or endorsements. Use of third-party tools is at your own risk and subject to third-party terms.

The Services may include links or content from third parties. We are not responsible for their content or accuracy and are not liable for any harm or damages from your use of third-party websites or services. Review third-party policies before engaging in any transaction.
SECTION 9 – RELATIONSHIP WITH SHOPIFY
Nobrainrot is powered by Shopify, enabling us to provide the Services. All sales are made directly Nobrainrot Shift. Shopify is not responsible for any sales between you and Shift, nor for any injury, damage, or loss resulting from your purchases.
SECTION 10 – PRIVACY POLICY
Your personal information is subject to our Privacy Policy and may also be subject to Shopify’s Privacy Policy . By using the Services, you acknowledge you have read these policies.
Because the Services are hosted by Shopify, your information may be transmitted to and processed by Shopify and third parties, possibly outside your country.
SECTION 11 – FEEDBACK & USER-GENERATED CONTENT
If you provide us with any feedback, suggestions, reviews, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, and display such Feedback for any purpose.
You represent and warrant that you have all necessary rights to your Feedback and that it does not violate any third-party rights or applicable law. We may remove Feedback at our discretion.
SECTION 12 – ERRORS, INACCURACIES, AND OMISSIONS
We may correct errors, inaccuracies, or omissions, and update information or cancel orders at any time without notice, including after an order has been submitted.

Nobrainrot is intended solely to help reduce digital distractions. It is not a medical device and should not be relied upon for emergency or critical use. You are responsible for using Nobrainrot safely and in compliance with local laws. Nobrainrot is not liable for consequences of misuse.
SECTION 16 – NO MEDICAL OR PROFESSIONAL ADVICE
Information provided by Nobrainrot is for informational purposes only and does not constitute medical or professional advice. Please consult a healthcare professional for any health concerns. Shift is not a substitute for medical treatment.
SECTION 17 – FORCE MAJEURE
Nobrainrot is not liable for delay or failure to perform due to causes outside our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, shortages, supply chain disruptions, or governmental action.
SECTION 18 – CHANGES TO PRODUCTS AND SERVICES
We reserve the right to modify, suspend, or discontinue any product or service at any time, without notice or liability.
SECTION 19 – LIMITATION ON DAMAGES
To the maximum extent permitted by law, our total liability for any claims related to these Terms or your use of Nobrainrot will not exceed the amount you paid for the product or service.
SECTION 20 – EXPORT CONTROL
You agree to comply with all applicable export and import laws. Nobrainrot makes no representation that the Services or products are appropriate or available in all locations.
SECTION 21 – CONSUMER RIGHTS/JURISDICTION FOR EU RESIDENTS
If you are a resident of the European Union, you may have additional rights under your country’s mandatory consumer protection laws. Nothing in these Terms limits those rights.
SECTION 22 – ARBITRATION
Unless otherwise required by law or you are an EU consumer, any disputes arising from these Terms or your use of the Services will be resolved by final and binding arbitration under the rules of the Arbitration Court in Poland.
SECTION 23 – RESERVATION OF RIGHTS
Any rights not expressly granted to you in these Terms remain the sole and exclusive property of Nobrainrot and its licensors.
SECTION 24 – DISCLAIMER OF WARRANTIES
Except as expressly stated, the Services and all products are provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee uninterrupted, timely, secure, or error-free operation of the Services.
SECTION 25 – LIMITATION OF LIABILITY
To the fullest extent permitted by law, in no case shall Nobrainrot, Nobrainrot, our partners, officers, employees, affiliates, agents, or Shopify be liable for any indirect, incidental, punitive, special, or consequential damages, including lost profits, lost data, or loss arising from your use of the Services or products, even if advised of the possibility.
SECTION 26 – INDEMNIFICATION
You agree to indemnify and hold harmless Nobrainrot, Nobrainrot, Shopify, and our affiliates, officers, directors, employees, agents, licensors, and service providers from any losses, damages, or claims arising out of your use of the Services or breach of these Terms.
SECTION 27 – SEVERABILITY
If any provision of these Terms is found unlawful or unenforceable, it will be enforced to the fullest extent permitted by law, and the remainder will remain in effect.

You may not transfer or assign these Terms or any rights or obligations without our written consent. We may assign our rights and obligations without consent or notice.

These Terms shall be governed by and construed in accordance with the laws of Poland (or your jurisdiction if required by applicable law). You consent to venue and jurisdiction in Poland, unless required otherwise.

Headings are for convenience only and do not affect the interpretation of these Terms.
SECTION 32 – CHANGES TO TERMS
We may update or change these Terms at any time by posting the revised version on our website. Material changes will be notified as required by law. Your continued use of the Services after changes constitutes acceptance of those changes.
